WEBSITE TERMS AND CONDITIONS — IRODA ATAEV
1. General Provisions and Definitions
1.1. The website www.irodaataev.com (hereinafter: the “Website”) is operated and managed by the Iroda Ataev brand / Website management (hereinafter: the “Website Management” and/or the “Business”).
1.2. The Website serves as an online store for equipment, materials, products and professional accessories in the fields of pedicure, manicure and podology, as well as for registration for classes, courses and professional training programs (hereinafter: the “Products” and/or the “Services”).
1.3. These Terms apply to all use of the Website, including browsing, viewing content, contacting the Business, registering and/or purchasing Products and Services through the Website.
1.4. By browsing or using the Website, the user and/or customer confirms that they have read and agreed to these Terms. If you do not agree with any provision of these Terms, please discontinue use of the Website.
1.5. Website Management reserves the right to update, modify or amend these Terms from time to time. The binding version is the version published on the Website at the time of the relevant action.
1.6. Any gender-specific wording used in the Hebrew version is for convenience only and applies equally to all genders.
2. Eligibility to Use the Website and Place Orders
2.1. Purchases and other transactions may be made by persons aged 18 or over who have legal capacity and use a valid payment method accepted by the Website.
2.2. Website Management may restrict a user's access to the Website or cancel an order, subject to applicable law, including where:
• the user has provided false or misleading information;
• the user's actions cause or may cause harm to Website Management or third parties;
• the user has breached these Terms;
• the Website has been used unlawfully or there is reasonable concern of fraud.
3. Nature of Products and Professional Use
3.1. Products and materials sold through the Website, including sharp professional instruments, cosmetic preparations and treatment materials, are primarily intended for professional use by professionals in the fields of pedicure and podology.
3.2. User responsibility: the customer confirms that they have the knowledge, training and skills required to use the Products correctly and safely. To the extent permitted by law, Website Management will not be liable for damage caused by incorrect, unprofessional or experimental use of the Products.
3.3. Sensitivity testing: the customer is responsible for performing an appropriate sensitivity test before extensive use of cosmetic preparations or treatment materials. To the extent permitted by law, Website Management will not be liable for individual sensitivities or allergic reactions to product ingredients.
3.4. Information, articles and educational materials published on the Website do not constitute medical advice and are not a substitute for professional medical diagnosis or treatment.
4. Orders, Prices and Availability
4.1. Product images are presented for illustrative purposes only. Minor differences in color, appearance or packaging may exist between the image displayed and the actual Product.
4.2. Website Management makes reasonable efforts to ensure that information, specifications and prices are accurate. If an obvious good-faith typographical error occurs in a product description or price, Website Management may, subject to applicable law, correct the error, cancel the affected order and refund any amount paid.
4.3. Prices are displayed in New Israeli Shekels (₪) and include VAT where legally applicable, unless expressly stated otherwise.
4.4. Website Management may change Product prices, handling charges and promotions at any time without prior notice.
4.5. All orders are subject to Product availability. If a Product becomes unavailable after an order has been placed, the customer will be contacted and offered an alternative Product, the option to wait for restocking or cancellation of the affected Product with a refund of the amount paid for it.
5. Payment Methods and Security
5.1. Payment may be made using valid credit cards and/or approved electronic payment methods, including Bit, bank transfer or other methods made available on the Website.
5.2. Transactions are processed through authorized payment providers using appropriate security measures, including SSL and PCI-DSS standards where applicable. Payment-card information is not stored on the Website's servers where payment is processed by an external provider.
5.3. An order is completed only after final payment authorization has been received from the relevant card issuer or payment processor.
6. Cancellation and Returns
6.1. Transaction cancellations are handled in accordance with the Israeli Consumer Protection Law, 1981 and applicable regulations.
6.2. Cancellation rights: customers may cancel purchases within the periods and subject to the conditions established under applicable consumer-protection law.
6.3. Limitations on returns:
• Opened materials and preparations: returns of opened or used cosmetics and other materials are subject to applicable legal restrictions according to the type of Product.
• Used equipment and instruments: returns of equipment, accessories or professional instruments that have been used are subject to applicable law and the Website's separate Returns Policy.
6.4. Detailed cancellation, return, exchange and refund terms are set out in the separate Cancellation, Returns and Exchanges Policy, which forms part of the purchase terms.
6.5. Course/workshop cancellations: cancellation of participation in courses, classes or workshops is subject to the specific cancellation terms provided at registration and applicable consumer law.
7. Intellectual Property
7.1. All intellectual-property rights relating to the Website, including the Iroda Ataev brand, the domain www.irodaataev.com, Website design, logo, photographs, text, Product specifications, educational videos, training materials and courses, belong to Website Management and/or the relevant rights holders.
7.2. Website content, photographs or information may not be copied, reproduced, distributed, sold, transmitted, published or commercially used without prior written permission, except where such use is permitted by law.
8. Limitation of Liability
8.1. The Website and its Services are provided on an “AS IS” basis. Website Management does not guarantee that the Website will be completely free from interruptions, technical failures or attempts at unauthorized access.
8.2. To the extent permitted by law, Website Management will not be liable for damage resulting from improper use of the Website, unreasonable reliance on its content or improper use of Products sold through it.
8.3. A user who breaches these Terms or uses the Website unlawfully will be responsible for damage caused by such conduct in accordance with applicable law.
9. Privacy and Marketing Communications
9.1. Website Management respects user privacy and operates in accordance with the Israeli Protection of Privacy Law, 1981, including Amendment No. 13 and other applicable legal requirements.
9.2. Personal information provided when placing an order or registering, including name, telephone number, email address and physical address, may be used for order fulfillment, customer service and business administration, as further described in the Website's separate Privacy Policy.
9.3. Marketing communications: subject to the user's consent and applicable law, Website Management may send updates, promotions and marketing communications by email, SMS or other permitted means. Users may unsubscribe at any time.
9.4. The Website may use Cookies and similar technologies for Website operation, security, improving user experience and statistical analysis, as further described in the Privacy Policy.
10. Governing Law and Jurisdiction
10.1. These Terms and the use of the Website are governed by the laws of the State of Israel.
10.2. Any dispute relating to the Website or these Terms will be heard by the competent court in accordance with applicable law.
